Article 3 – Scope of application
These general terms and conditions apply to all offers from the entrepreneur as well as to all distance contracts concluded and to all orders placed between the entrepreneur and the consumer.
Before the conclusion of the distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract that the general terms and conditions can be consulted at the trader's premises and that they will be sent to the consumer free of charge upon request.
If the distance contract is concluded electronically, and notwithstanding the preceding paragraph, the text of these general terms and conditions may be made available to the consumer electronically in such a way that it can be easily recorded on a durable medium.
If this is not reasonably possible, it will be indicated before the conclusion of the distance contract where the general terms and conditions can be consulted electronically and that they will be sent free of charge to the consumer on request, either electronically or otherwise.
In the event that specific conditions for products or services apply in addition to these general terms and conditions, the second and third paragraphs apply by analogy and the consumer may always avail themselves of the most favorable provision in the event of a conflict between the general terms and conditions.
If one or more provisions of these terms and conditions are wholly or partially invalid or void, the contract and other terms and conditions shall remain in effect, and the provision in question shall be replaced by a provision that comes as close as possible to it.
Situations not covered by these general conditions must be assessed "according to the spirit" of these general conditions.
Any doubt concerning the interpretation or content of one or more provisions must be resolved "in accordance with the spirit" of these general terms and conditions.
